European Union
One directive, twenty-seven implementations — and one forum that was already doing the work.
The Representative Actions Directive obliges every member state to provide a collective redress procedure for consumer claims, brought by qualified entities rather than by individual claimants. Implementation is uneven, and forum choice within the Union now matters as much as it does between jurisdictions.
The Netherlands remains the practical centre of European collective litigation. The WAMCA regime permits damages claims by a representative foundation, admits non-Dutch class members, and has produced the Union's most substantial body of collective case law.
